1. Parties and definitions
The service is provided by the legal entity identified below ("we", "the provider"). The other party is the company in whose name the account is created ("you", "the client").
These terms are an agreement between two businesses (B2B). The platform is offered for professional use by construction companies and is not directed at individual consumers; consumer-protection rules do not apply to this relationship, except where mandatory law expressly provides otherwise.
- Address
- Prishtinë, Kosovë
- "Platform" or "Service" — the BuildMetrica web application, reachable through your company's subdomain, together with the public site and ancillary services.
- "Account" — your company's dedicated space, separated from every other company, together with the users you create inside it.
- "Owner" — the user who created the account; this role is immutable and holds the billing, export and deletion rights.
- "Client data" — any data entered by you or your users inside the account.
- "Plan" — the chosen subscription package, with the limits and price published on the pricing page at the time of signing up.
2. The service
BuildMetrica is a web platform for construction companies that build and sell residential units: recording complexes, buildings and units, managing clients, contracts, instalments and payments, tracking materials and expenses, issuing invoices and reporting.
Each company works in a separate space, reachable through its own subdomain, on a dedicated database. The available features and limits are determined by the chosen plan, as published on the pricing page.
The service is under continuous development. We may add, change or remove features; if we remove a feature that is core to your current plan, we notify you in advance under section 15. We do not promise features that are not yet available.
3. Account and registration
To create an account you must be a registered legal entity or trader, and the person completing registration must have authority to bind that entity.
- Registration details must be accurate, complete and kept up to date.
- An account belongs to one company. Creating accounts for other entities without their authorisation is not permitted.
- The account owner assigns users and each user's permissions, and is responsible for them.
- Acceptance of these terms is mandatory at registration and is enforced server-side; without it, the account is not created.
4. Client responsibilities
The security and accuracy of your account are a shared responsibility: we protect the platform, you protect access to it and answer for what goes into it.
SHARED RESPONSIBILITY FOR BACKUPS. The platform performs regular, encrypted operational backups as a measure of our own service continuity — not as an archiving service for you. In addition, the account owner can start a FULL EXPORT of the company's data at any time. Maintaining independent copies of critical data, by means of that export, remains the client's responsibility.
- You are responsible for safeguarding credentials and for every action taken by the users you create. We strongly recommend enabling two-factor authentication.
- You are responsible for the lawfulness of your use and for your rights over the data you enter, including the legal basis for buyers' personal data.
- You are responsible for the accuracy of the data entered. The figures, invoices and reports the platform produces derive from what you enter and must be checked before any official or tax use.
- You are responsible for keeping independent copies through the full export, as set out above.
- Notify us immediately if you suspect the account has been used without authorisation or that credentials have been compromised.
5. Subscription, trial, billing and non-payment
Payments are processed through RaiAccept, the payment service of Raiffeisen Bank Kosovo. We do not see, receive or store full card details.
- Every plan has a trial period whose length is shown on the pricing page at the time of registration. Depending on the current configuration, starting the trial may require a valid payment method. The trial can be cancelled at any time with no obligation.
- The subscription is paid in advance for the chosen period. Published prices include VAT where VAT applies.
- Renewal is confirmed by you with a single action at the end of the period. We charge no card without your action; before expiry we send an email notice.
- You may cancel at any time; cancellation stops renewal and access continues to the end of the period already paid for. Started periods are not refunded pro rata, except where mandatory law requires otherwise.
- If payment is not made on time, the account enters an overdue state and receives a grace window during which access continues and we send reminders. After it, access is suspended until payment is made; data is not deleted during suspension.
- A VAT invoice is issued for every payment made, available for download inside the subscription section.
- If the service has been unavailable for a prolonged period through our fault, we credit the corresponding share of the fee; contact us and we settle it case by case.
6. Acceptable use
The service may not be used for unlawful purposes, nor in ways that harm the platform, other clients or third parties.
- Do not attempt to access another company's data, bypass access controls, or test security without prior written agreement.
- Do not upload unlawful content, malicious code, or material you have no rights to.
- Do not load the service with automated traffic that degrades it for others, and do not extract data by automated means beyond the features provided.
- Do not resell, sublicense, rent out or make the service available to third parties without a separate written agreement.
- Do not use the platform's notification channels for mass communications unrelated to the service.
7. Intellectual property and data ownership
The platform — its code, design, brand, documentation and every improvement to it — remains our property. These terms grant you a non-exclusive, non-transferable, revocable licence to use the service for as long as the subscription is active.
CLIENT DATA REMAINS THE CLIENT'S PROPERTY. We claim no ownership over it, do not use it for purposes other than providing the service, do not sell it and do not use it to train models. The only licence you grant us is the technical one needed to store, display and process it in performing the service.
- Key lists can be exported to CSV straight from the application: payments, instalments, invoices, expenses, material deliveries and the notification log.
- Every uploaded document and every PDF invoice can be downloaded at any time.
- The account owner can start a full export of the company's data, at any time, directly from the application.
- If you send us suggestions or improvement ideas, we may use them freely without obligation to you — this affects no right over your data.
8. Availability and maintenance
We make industry-standard efforts to keep the service available, but we do NOT guarantee uninterrupted, error-free or continuously available operation.
We announce planned maintenance in advance where it is expected to affect use, and we try to perform it outside working hours. Urgent security work may be carried out immediately and without prior notice, where delay would increase the risk.
9. Security
We apply technical and organisational measures to industry standards: data isolation per company in a separate database, traffic over HTTPS, passwords stored only as hashes, two-factor authentication, fine-grained per-user permissions, an immutable activity log and encrypted backups.
Nevertheless, no system is absolutely secure. We give NO ABSOLUTE GUARANTEE against unauthorised access, data loss or third-party interference. Applying these measures is not a promise of outcome.
You are required to notify us without delay of any security incident affecting your account, and to cooperate in investigating it. We notify you of incidents affecting your data within the deadlines set by data-protection legislation.
10. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied.
To that extent, we expressly disclaim any implied warranty of merchantability, fitness for a particular purpose or non-infringement, and any warranty that the service will be uninterrupted, secure or error-free, or that the results obtained from it will be accurate or suitable for any particular use.
BuildMetrica is a supporting tool, not a substitute for professional judgement, accounting, or legal or tax advice.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, we are not liable for indirect, incidental, special, consequential or punitive damages, including — without limitation — loss of data, loss of profit, loss of anticipated savings, business interruption or damage to reputation, whether arising from an outage, a defect, loss of data or a third-party attack, and whether or not we were advised of their possibility.
To that extent, our total aggregate liability to you for any claim connected with the service is limited to the amount of subscription fees you paid during the twelve (12) months preceding the event giving rise to the claim.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS liability that cannot be excluded by law. This expressly includes: damage caused intentionally or by gross negligence; damage to life, body or health; liability under personal-data-protection legislation; and any other liability mandatory under applicable law.
The limitations in this section apply on any basis of liability — contractual, non-contractual or otherwise — and survive even if a remedy provided for here fails of its essential purpose.
12. Force majeure
Neither party is liable for failure or delay caused by circumstances beyond its reasonable control. Obligations are suspended for the duration of the event, and the affected party notifies the other as soon as reasonably possible.
- Third-party cyberattacks, including denial-of-service attacks and ransomware.
- Failures of hosting infrastructure, power or cooling at data centres.
- Outages of the internet, transit networks or necessary service providers, including the payment processor and email delivery.
- Acts of public authorities, legal changes with immediate effect, embargoes or sanctions.
- Natural disaster, fire, flood, war, terrorism, civil unrest and general strike.
- If the event lasts more than thirty (30) consecutive days, either party may terminate the agreement by written notice, with no obligation to the other beyond fees unpaid for service already rendered.
13. Indemnification
You agree to defend and indemnify us and our personnel against any claim, loss, fine or reasonable expense — including reasonable legal costs — arising from your unlawful use of the service or that of the users you create.
- Breach of these terms, in particular section 6 on acceptable use.
- Content or data entered by you that infringes third-party rights.
- Processing of personal data by you without a valid legal basis, or contrary to your own instructions to us as processor.
- This obligation does not apply to the extent the claim arises from our breach of these terms or from our intent or gross negligence. We notify you of any claim without delay and settle nothing without your reasonable consent.
14. Suspension, termination and return of data
You may close the account at any time. We may suspend or terminate it for serious breach of these terms or continued non-payment, after notice and a reasonable period to remedy — except in cases of serious abuse or immediate security risk, where suspension may be immediate.
DATA-RETURN WINDOW: after termination, your company's data is kept for at least thirty (30) days, during which the owner can start the full export and download every document. After that window we delete it on your request or through our internal procedure, except what we are legally required to retain and residues in backups until the rotation horizon expires.
Sections that by their nature survive termination — intellectual property, disclaimer of warranties, limitation of liability, indemnification, confidentiality and governing law — remain in force after it.
15. Changes to these terms
We may update these terms. Every version carries a version number and an effective date, both visible at the top of this page.
Material changes — those affecting price, your rights or the main obligations — are notified by email to the account owner's address at least thirty (30) days before they take effect. If you do not agree, you may cancel the subscription before the effective date; continued use after that date constitutes acceptance.
Linguistic corrections and clarifications that do not change meaning require no prior notice.
16. Severability and entire agreement
If a provision of these terms is held invalid or unenforceable by a competent court, that provision applies to the maximum extent permitted, or is replaced by a valid provision approximating its original purpose as closely as possible. The remainder of the terms stays in full force.
Failure or delay in exercising a right is not a waiver of it. These terms, together with the privacy policy and the cookie policy, constitute the entire agreement between the parties on their subject matter and supersede any prior agreement on the same subject.
You may not assign your rights or obligations under this agreement without our written consent; we may assign them in a merger, acquisition or transfer of business, with prior notice.
17. Governing law and disputes
These terms are governed by the law of the Republic of Kosovo, without regard to its conflict-of-laws rules.
For any dispute the parties first attempt an amicable resolution within thirty (30) days of written notice. Failing that, the courts of Prishtina, Republic of Kosovo, have jurisdiction.
18. Contact
For any question about these terms, for the notices they provide for, or for contractual matters, write to the contact address listed in the provider identity block at the top of this page, or use the contact form on this site.
Written notices required by these terms are deemed delivered when sent by email to the account owner's address, respectively to our contact address.
